Non-compliant demands are challengeable

Any leaseholder can take your demand to the First-tier Tribunal and argue it doesn't follow the approved Code. The tribunal can rule it unreasonable — meaning you can't collect the money.

Apportionment schedules — do you have one?

The new Code requires you to show each leaseholder's percentage and how it was calculated. Most RTM boards have never produced one. You'll need one for every demand from April 7th.

Common questions about the new Code

Yes. The Approval of Code of Management Practice Order 2026 was made on 12 March 2026 and comes into force on 7 April 2026. The RICS published the final Code on 17 March. It's confirmed and there's no consultation period — it's happening.
The Code itself sets out best practice, but it's approved by the Secretary of State under section 87(7) of the Leasehold Reform, Housing and Urban Development Act 1993. That means the First-tier Tribunal can and does refer to it when deciding disputes. Non-compliance can be used as evidence against you.
If you issue service charge demands, yes. The Code applies to all residential leasehold properties in England where variable service charges are collected. RTM companies are specifically covered. The Code doesn't care that you're a volunteer — your demands still need to comply.
